1. Acceptance of Terms

By purchasing, accessing, or using any service provided by ZoneCloud.net (“ZoneCloud”, “we”, “our”, or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use our services.

ZoneCloud.net reserves the right to modify these Terms at any time. Updated versions will become effective upon publication on our website. Continued use of our services after any changes constitutes acceptance of the revised Terms.


2. Acceptable Use Policy

All ZoneCloud.net services may only be used for lawful purposes. Customers agree not to use our services to engage in, promote, facilitate, or support any activity that violates applicable laws or regulations.

Prohibited activities include, but are not limited to:

  • Distribution of illegal content.
  • Copyright infringement or intellectual property violations.
  • Fraudulent, deceptive, or misleading activities.
  • Unauthorized access to systems, networks, or data.
  • Distribution of malware, viruses, or malicious software.
  • Operation of services intended to disrupt or harm other networks, systems, or users.
  • Any activity that may damage the reputation, infrastructure, or operations of ZoneCloud.net.

ZoneCloud.net reserves the right to suspend or terminate services that violate this policy.


3. User Content

Customers are solely responsible for all content stored, transmitted, published, or distributed through their accounts.

Users must not upload, publish, transmit, or distribute content that is:

  • Illegal, defamatory, abusive, threatening, or harassing.
  • Obscene, hateful, or discriminatory.
  • Infringing upon the intellectual property rights of others.
  • Fraudulent or misleading.
  • Harmful to minors.
  • In violation of any applicable law or regulation.

ZoneCloud.net does not actively monitor customer content but reserves the right, at its sole discretion, to remove, disable access to, or report content that violates these Terms or applicable laws.

We may disclose customer information or content when required by law, court order, legal process, or governmental request.


4. Network Security

Customers may not attempt to circumvent, compromise, or interfere with the security of any network, system, account, or service.

Prohibited activities include:

  • Unauthorized access to data, systems, or accounts.
  • Password cracking or credential theft.
  • Security scanning, probing, or vulnerability testing without authorization.
  • Denial-of-service (DoS) attacks.
  • Network flooding or mail bombing.
  • Any attempt to disrupt service availability for other users.

ZoneCloud.net will cooperate fully with law enforcement and regulatory authorities investigating suspected violations of law or network security.


5. Server Resource Usage

Customers must use server resources fairly and responsibly.

Accounts that consume excessive CPU, memory, storage, bandwidth, or other system resources may be required to:

  1. Reduce resource consumption;
  2. Upgrade to a higher-tier service plan; or
  3. Migrate to a service better suited to their requirements.

ZoneCloud.net reserves the right to suspend or limit services that negatively impact overall server performance or stability.


6. Prohibited Services and Applications

The following activities are prohibited unless expressly authorized by ZoneCloud.net:

  • IRC servers or IRC bots.
  • Unauthorized background daemons or persistent processes.
  • Resource-intensive chat systems that adversely affect server performance.
  • CGI scripts or applications that compromise server stability or security.
  • Bulk email services or mass-mailing platforms.

ZoneCloud.net reserves the right to disable any application that adversely affects server performance, security, or network integrity.


7. Anti-Spam Policy

The use of ZoneCloud.net services for unsolicited bulk email (“spam”) is strictly prohibited.

Customers may not use ZoneCloud.net systems, domains, IP addresses, or email services to send, facilitate, relay, or promote unsolicited commercial email.

Violation of this policy may result in:

  • Immediate suspension or termination of service.
  • Removal of hosted content.
  • Administrative fees associated with abuse investigations and remediation.
  • Reporting to relevant anti-spam organizations or authorities.

ZoneCloud.net reserves sole discretion in determining whether activity constitutes spam.


8. Technical Support

ZoneCloud.net provides technical support for services directly offered by us.

Technical support does not include:

  • Custom programming.
  • Website development.
  • HTML, CSS, JavaScript, or application coding.
  • Third-party software installation or troubleshooting unless specifically included in the service plan.

Customers are expected to communicate respectfully with our staff. Abusive, threatening, discriminatory, or harassing behavior toward employees may result in suspension or termination of services.


9. Intellectual Property

Customers must respect all intellectual property rights, including copyrights, trademarks, patents, and trade secrets.

Users may not use ZoneCloud.net services to store, distribute, or transmit materials that infringe upon the rights of any third party.

Customers are solely responsible for ensuring that all content hosted through their accounts complies with applicable intellectual property laws.


10. Domain Registration

Where ZoneCloud.net registers or renews domain names on behalf of customers, ownership remains subject to the applicable registry and registrar policies.

Any promotional or discounted domain registration offered as part of a hosting package may be subject to recovery of the standard registration cost if hosting services are cancelled before the applicable promotional period has ended.

Domain transfers may be withheld until all outstanding fees have been paid in full.


11. Service Suspension and Termination

ZoneCloud.net reserves the right to suspend or terminate services at its sole discretion for:

  • Violations of these Terms.
  • Illegal activities.
  • Security threats.
  • Abuse of network resources.
  • Non-payment of fees.
  • Actions that place ZoneCloud.net, its infrastructure, customers, or reputation at risk.

Termination for violations of these Terms may occur without prior notice and may not be eligible for a refund.

12. Billing and Refunds

12.1 Payment Terms

All services provided by ZoneCloud.net are billed in advance and must be paid in full by the due date indicated on the invoice. Failure to maintain a current payment status may result in service suspension or termination.

Customers are responsible for ensuring that payment information remains accurate and up to date.

12.2 Refund Policy

Unless otherwise stated in writing, customers may request a refund within the first fifteen (15) days of their initial hosting service term.

The following items are non-refundable:

  • Domain name registrations, renewals, transfers, and redemption fees.
  • Software licenses.
  • Dedicated servers, VPS services, or custom-configured services.
  • Administrative fees.
  • Third-party products and services.
  • Services terminated due to violations of these Terms of Service.

Refund requests submitted after the applicable refund period will not be eligible for reimbursement.

12.3 Billing Disputes

Any billing inquiry, disputed charge, or invoice discrepancy must be reported within fifteen (15) days of the charge date.

Failure to notify ZoneCloud.net within this period constitutes acceptance of the charge.

12.4 Chargebacks

Customers agree to contact ZoneCloud.net and make reasonable efforts to resolve any billing dispute before initiating a chargeback or payment reversal.

If a chargeback is filed for a valid charge and subsequently determined to be unwarranted, ZoneCloud.net reserves the right to suspend or terminate services and recover any associated administrative, processing, collection, legal, and recovery costs permitted by law.

12.5 Account Suspension for Non-Payment

Accounts with overdue balances may be suspended without notice. Services may be restored upon payment of all outstanding balances and any applicable reinstatement fees.

ZoneCloud.net is not responsible for any loss of data, business interruption, or damages resulting from account suspension due to non-payment.

13. Backups and Data Responsibility

13.1 Customer Responsibility

Customers are solely responsible for maintaining current and complete backups of all data, websites, databases, emails, applications, and other content stored through ZoneCloud.net services.

Customers should regularly create and verify backups and maintain copies in a separate location independent of ZoneCloud.net infrastructure.

13.2 Backup Services

Unless expressly stated in a service plan or written agreement, backup services are not included with hosting services.

Any backup systems provided by ZoneCloud.net are offered as a convenience only and are not guaranteed.

13.3 No Guarantee of Data Recovery

ZoneCloud.net does not guarantee the availability, integrity, accuracy, completeness, or recoverability of any backup.

Customers acknowledge that hardware failures, software failures, user error, security incidents, natural disasters, and other unforeseen events may result in partial or complete data loss.

13.4 Limitation of Liability for Data Loss

ZoneCloud.net shall not be liable for any loss of data, corruption of data, restoration costs, loss of business, loss of profits, or any indirect, incidental, special, consequential, or punitive damages arising from data loss, failed backups, or inability to restore data.

13.5 Best Practices

Customers are strongly encouraged to maintain multiple backup copies using the “3-2-1” backup principle:

  • Three copies of important data.
  • Stored on at least two different types of media.
  • With at least one copy stored offsite or in a separate cloud environment.

Maintaining adequate backups remains the sole responsibility of the customer.
